Terms of Service

You must be at least 18 years old and able to form a binding contract to use Cashly. You agree to provide accurate information, keep your credentials confidential, and are responsible for all activity under your account. Notify us at security@mycashlyapp.com if you suspect unauthorized access. We recommend enabling multi-factor authentication from Profile → Security.

Cashly helps you budget, track spending, manage bills and debts, set savings goals, and receive AI-generated financial coaching. Features include connecting financial accounts through Plaid, automatic transaction categorization, cash-flow forecasts, alerts, and monthly plans. Availability of specific features may change over time.

You may connect financial accounts using Plaid. When you do, you authorize Plaid to access read-only account and transaction data from your institution on your behalf and to share that data with Cashly. Your bank credentials are entered directly in Plaid's interface and are never seen or stored by Cashly. You can disconnect any linked institution at any time from Profile → Connected bank accounts. Your use of Plaid is also subject to Plaid's own end-user privacy policy.

You agree not to:

• Reverse engineer, decompile, or attempt to extract source code from the Service.
• Scrape, crawl, or bulk-download data from the Service.
• Probe, scan, or test the vulnerability of any system without written permission, or circumvent authentication, rate limits, or security controls.
• Use the Service to store or transmit unlawful, infringing, or abusive content.
• Use the Service on behalf of another person without their permission, or share your account credentials.
• Interfere with other users' use of the Service or with our infrastructure.

We may suspend or terminate access for violations.

Cashly Gold is an optional paid subscription that unlocks additional features. Billing is processed by Stripe or the applicable app store. Subscriptions renew automatically for the term you selected until cancelled. You can cancel at any time from Profile → Subscription; access continues through the end of the current billing period, and payments already made are non-refundable except where required by law. We may change pricing on renewal with advance notice. For billing questions or receipts, email billing@mycashlyapp.com.

If we offer a free trial, we will describe its length and terms at sign-up. Unless you cancel before the trial ends, your subscription converts to a paid plan at the then-current price.

Cashly provides informational tools and AI-generated insights based on the data you connect. We are not a bank, broker-dealer, tax advisor, or licensed financial planner. AI outputs may contain errors or omissions. You are solely responsible for decisions you make based on the Service, and you should consult a qualified professional for advice specific to your situation.

You retain ownership of the information and content you provide to Cashly (for example, budgets, goals, notes, and messages to the AI coach). You grant Cashly a limited license to host, process, and display that content solely to operate and improve the Service for you. We do not sell your personal information.

The Service includes AI-generated features (for example, the AI Coach and insights). Your conversations and connected financial data may be processed by our AI providers under contract to generate responses. Do not rely on AI outputs as professional advice, and do not share information you would not want processed by an AI system.

The Service integrates with third parties including Plaid (bank connectivity), Stripe (billing), our cloud hosting and database provider, our email delivery provider, and AI model providers. Your use of those services is also subject to their own terms and privacy policies. We are not responsible for third-party services or content.

Cashly and its licensors own all rights in the Service, including software, design, and trademarks. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial financial management.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DATA IMPORTED THROUGH PLAID OR OTHER SOURCES WILL BE COMPLETE OR ACCURATE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CASHLY AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) USD $100.

You will defend and indemnify Cashly against claims and losses arising from your misuse of the Service, your violation of these Terms, or your violation of any law or third-party right.

You may close your account at any time from Profile → Privacy & security. We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the integrity of the Service. On termination, your right to use the Service ends immediately; sections that by their nature should survive (including disclaimers, limitations of liability, and dispute resolution) will survive.

We may change the Service or these Terms from time to time. Material changes to these Terms will be announced in-app before they take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law rules. Any dispute arising from these Terms or the Service will be resolved exclusively in the state or federal courts located in Delaware, and you consent to their jurisdiction, except where prohibited by applicable local law.
